Information about Beach Fires & Cooking on Balcony

We provide fire and non-transport Advanced Life Support Emergency Medical Services (EMS) to both the City of Cape Canaveral and the Canaveral Port Authority. Have questions? Just call 321-783-4424 for non-emergency between 8am to 5pm.
City Code Section 54-3.
Open Fires Restricted.
No person shall ignite or participate in igniting an open fire in, on or over the beaches or public parks within the City of Cape Canaveral including campfires and bonfires.  Notwithstanding the foregoing, lighting a fire for the purpose of cooking is permitted provided such fire is contained wholly within a container or device manufactured for cooking purposes and approved by the City’s Fire Chief or his designee.

Storage of L.P. Gas or Gas Grills
The Florida Fire Prevention Code also prohibits the storage or use of L.P. gas in quantities greater than 1 pound above the first floor in any apartment or condominium. Therefore, L.P. gas grills cannot be stored on a balcony. It is important to note that L.P. gas cylinders cannot be stored inside the residential unit or anywhere above the first floor.

The specific code sections are as follows:
The 6th Edition of the Florida Fire Prevention Code as adopted by the Florida Legislature in Florida Statue 633 and the Florida
Florida Fire Prevention Code 6th Edition and NFPA 1, 2017 Edition
10.1.6 Cooking Equipment.
10.10.6.1 For other than one- and two-family dwellings. no hibachi, grill. or other similar devices used for cooking, heating. or any other purpose shall be used or kindled on any balcony, under
any overhanging portion or within 10 ft (3M) of any structure.
10.10.6. 1.1 Listed electric portable tabletop grills, not to exceed 200 square inches of cooking surface, or other similar apparatus shall be permitted.
10.10.6.2 For other than one- and two-family dwellings, no hibachi grill, or other similar devices used for cooking shall be stored on a balcony.
10.10.6.3* Listed equipment pertinently installed in accordance with its listing, applicable codes, and manufacturer’s instructions shall be permitted.
69.5.3.5 Storage Within Residential Buildings.
Storage of cylinders within a residential building including the basement or any storage area in a common basement or a multiple-family building and attached or detached garages, shall be limited to cylinders each with a maximum water capacity of 2.7 lb ( 1.2 kg) and shall not exceed
5.4 lb (2.4 kg) aggregate water capacity per each living space unit. [58:8.3.5]
F.S 633.025 Minimum fire-safety standards-
(2) Pursuant to subsection (I), each municipality. county, and special district with fire-safety responsibilities shall enforce the Florida Fire Prevention Code and the Life Safety Code as the minimum fire-safety code required by this section.
